BRIBERY

For a change of pace, I think you might enjoy reading this give and take between Karla Espinal, Jerry’s ex-wife, and F. Lee Bailey. The setting is she is testifying against Jerry on a variety of charges, including murder, and Bailey is cross-examining.

Bailey: Now, was there great concern that you shared with Jerry about the fact that if he were indicted, charged and convicted for importation in Montgomery, Alabama, that the sentenced he would receie from the Court in this city would be severe?

Karla: Yes, that’s correct.

Bailey: Indeed, at the time that all this was going on, were not lawyers from Chicago busying themselves, threatening Jerry on the one hand and offering to fix the case on the other?

Karla: That’s correct.

Bailey: One Del Valle by name?”

Karla: Yes

Bailey: Was that not being done?

Karla: Yes, Ken Del Valle came down and tried to have Jerry pay him a million dollars for an indictment not to come out.

Bailey: More specifically, Del Valle said if you don’t pay me a million dollars I am going to have DeFranco testify against you, didn’t he?

Karla: I thought---what Jerry told me was that he said you give me a million dollars and I will guarantee that you won’t get indicted here.

Bailey: That was the other half of the deal.

Karla: Yeah.

Bailey: He could fix it on the other hand, and if Jerry didn’t pay him, his client, DeFranco was going to put him away, right?

Karla: I don’t know about that, all I know is that he said if you don’t pay the million dollars, you are going to  get indicted.

(The questioning moved to other areas before returning to the bribe. Bailey’s tactics were to jump around, possibly to confuse, before tying it all up later.)

Bailey: Did you understand that if Del Valle made good on his threats and had his client, DeFranco, testify about the Montgomery, Alabama importation that that was the curtain call for Jerry Allen LeQuire?

Karla: I wasn’t aware of the threat that DeFranco was going to testify. I was aware of the threat that Del Valle, if he didn’t get paid, was going to cause some way or another for Jerry to get indicted.

Bailey: And Del Valle did get a lot of money, didn’t he?

Karla: Pardon?

Bailey: He got a lot of money, didn’t he, Del Valle?

Karla: Yes, he did.

Bailey: For doing practically nothing, correct?

Karla: I guess so, yes.

Bailey: Well, DeFranco’s case got dismissed?

Karla: That’s correct.

Bailey: And then he made a deal with the government before he got reindicted.

Karla: That’s correct

Bailey: Well, that’s the last we ever saw of Mr. Del Valle, right?

Karla: Correct.
